MOAC Mall Holdings LLC v. Transform Holdco LLC is a bankruptcy case involving whether a specific bankruptcy provision is jurisdictional. MOAC argues that it isn’t jurisdictional because there is no “clear statement” in the text of the provision. Transform doesn’t spend too much time on the argument the Court granted review on, but it does say that the statute is best read as jurisdictional because it takes away a right to appeal.
